Terms of Use
These terms apply to the mobile games published by Karambola ("we", "us"): Trail Recall, Code Vault, Orbit Shelves, Parcel Inspector, Lights Out Lab and any future game that links to this page (each a "Game"). They also cover this website. By downloading, installing or playing a Game you agree to these terms. If you don't agree, please don't use the Games.
You also agree to the terms of the store you downloaded the Game from: the Apple Media Services Terms for the App Store, or the Google Play Terms of Service. Our Privacy Policy explains how data is handled.
1. Who can play
The Games are general-audience games, not directed at children under 13. If you are under the age of majority where you live, a parent or guardian should review these terms with you.
2. Your licence
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install the Games on devices you own or control and play them for your own non-commercial entertainment. On iPhone, this licence follows the App Store's Usage Rules.
You agree not to:
- copy, modify, translate, decompile or reverse engineer the Games, except where the law expressly allows it;
- sell, rent, sublicense or redistribute the Games or any part of them, including their art, sounds or levels;
- use cheats, bots, modified clients or automated tools, or interfere with how the Games or their ads work;
- generate fake ad views or taps, or otherwise defraud our advertising partners;
- use the Games in any way that breaks the law or these terms.
3. Free Games and optional ads
The Games are free to download and play. Some features can be unlocked by choosing to watch a rewarded ad, such as a hint, a slower replay or a retry with a slower belt. Ads are always optional, and you can keep playing without them. If an ad is unavailable or closed early, no reward is given and nothing is lost.
Ads are supplied by third parties such as Google AdMob and its mediation partners. We don't control or endorse what is advertised, and any dealings with advertisers are between you and them.
4. Rewards and progress
Hints, stars, levels and other in-game items have no monetary value. They can't be sold, transferred or exchanged for money, and they give you a licence to use them in the Game, not ownership. Your progress is stored only on your device. We can't restore it if the Game is deleted, reset or the device is lost, and we may rebalance levels, stars or hints in updates.
5. Ownership
The Games, including their code, level generators, art, sounds, names and logos, belong to Karambola or its licensors and are protected by intellectual property laws. Apart from the licence in section 2, these terms give you no rights to them. "App Store" is a trademark of Apple Inc. "Google Play" is a trademark of Google LLC.
6. Feedback
If you send us ideas or suggestions, we may use them freely without any obligation to you.
7. Updates and availability
We may update, change, suspend or stop offering any Game at any time. We may do this to fix bugs, adjust levels, add or remove features or ad partners, or comply with store rules or the law. Some updates may be required to keep playing. We are not obliged to provide updates or support, but you can always reach us at support@karambola.app.
8. Ending these terms
You can stop at any time by deleting the Game. If you seriously break these terms, for example by committing ad fraud, your licence ends automatically. Sections 4 to 6 and 9 to 13 still apply after the terms end.
9. No warranty
The Games and this website are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied. This includes merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the Games will be uninterrupted, error-free or compatible with your device.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost progress, data or profits, arising from your use of, or inability to use, the Games, even if we were told such damage was possible. Our total liability for any claim relating to the Games is limited to the amount you paid us for the Game, which for these free Games is zero, or USD 50, whichever is greater.
11. Your consumer rights
Nothing in these terms limits rights you have under consumer protection laws that can't be waived or limited by contract. If a part of these terms is not allowed where you live, it doesn't apply to you, and the rest still does.
12. Apple App Store additional terms
If you downloaded a Game from the Apple App Store, these terms also apply:
- These terms are between you and Karambola only, not Apple. Karambola, not Apple, is solely responsible for the Game and its content.
- Apple has no obligation to provide any maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
- Karambola, not Apple, is responsible for addressing any claims by you or any third party relating to the Game or your possession and use of it. This includes product liability claims, claims that the Game fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the Game or your possession and use of it infringes their intellectual property rights, Karambola, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce these terms against you as a third-party beneficiary.
13. General
If any part of these terms can't be enforced, the rest remains in effect. If we don't enforce a right, we haven't waived it. You may not transfer your rights under these terms. We may transfer ours, for example if a Game is sold to another publisher, and these terms will continue to apply. These terms and the Privacy Policy are the whole agreement between you and us about the Games.
14. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is significant, we'll mention it in the Game's update notes. Continuing to play after a change takes effect means you accept the new terms.
